Welcome to YourBike.cc (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of the website www.yourbike.cc (the “Site”), and any purchase of products from us— whether the order is placed online via the Site or offline (e.g. via email, phone, direct invoice, quotation or other communication channels). By using the Site or By placing an order, you agree to be bound by these Terms. If you do not accept these Terms, please do not place an order or use the Site.

 

1. Definitions & Applicability

  1. “Customer”, “you”, “your” refers to any visitor to the Site and/or any person or entity placing an order, whether online or offline.

  2. These Terms apply to all purchases of products from us, including “Frame Only”, “Configurations”, and any other products or services offered.

  3. By placing an order, the Customer declares they are at least 18 years old (or have parental/guardian consent if under 18) and legally capable of entering into binding contracts.

  4. For B2B purchases, these Terms also apply unless a separate written agreement is made. Any Customer general purchasing conditions are expressly rejected unless agreed in writing.

 

2. Orders, Order Acceptance & Contract Formation

  1. All online and offline orders placed by you are subject to acceptance by us. We reserve the right to accept or reject any order — for example, due to product unavailability, errors in pricing or description, or lack of solvency.

  2. A sales contract is formed only when we send you a confirmation notice (e.g. by email or invoice confirmation). Until then, you have no legal claim to the products.

  3. We reserve the right to cancel orders even after acceptance (e.g. if stock runs out) — in that case we will refund any amounts paid.

  4. All product images, descriptions and specifications are for illustration only. Actual products may differ slightly due to screen settings, photography or manufacturing differences.

 

3. Prices & Payment

  1. All prices are stated in Euros (€) and include statutory VAT (unless otherwise specified).

  2. Prices are valid at the moment of order acceptance.

  3. Shipping costs (if applicable) are communicated during the online checkout or in the offline quotation/invoice.

  4. Payment must be completed at the time of order finalization, unless agreed otherwise in writing.

  5. We accept the payment methods displayed at checkout or listed in offline quotations and/or invoices.

 

4. Shipping & Delivery

  1. Products will be delivered to the shipping address provided by the Customer during the order process (online or offline).

  2. Estimated delivery times and costs are stated on our website or communicated directly for offline orders.

  3. If a product becomes unavailable after order confirmation, we will notify you as soon as possible and refund any payment made.

  4. Risk of damage or loss transfers to the Customer upon delivery.

 

5. Right of Withdrawal / Returns & Refunds

  1. Consumers purchasing through our online store or via distance selling (email, phone, etc.) may withdraw from the purchase within 14 calendar days after receiving the product.

  2. This right does not apply to custom‑colored frames or other personalized items.

  3. To exercise the right of withdrawal, the Customer must notify us in writing before the withdrawal period expires.

  4. Returned products must be in the same condition as received — unused, with all original packaging, parts and accessories.

  5. If the product shows signs of use beyond what is necessary to establish its nature and functioning, we may deduct depreciation from the refund.

  6. We will refund the product price (excluding original shipping costs) within 14–30 days after receiving the returned product, depending on our internal policy.

  7. B2B purchases do not include a right of withdrawal unless explicitly agreed in writing.

 

6. Use of the Website — Acceptable Use

By using the Site, you agree not to:

  • Use the Site for illegal or unauthorized purposes

  • Upload or transmit harmful code (viruses, malware, etc.)

  • Attempt unauthorized access to systems or accounts

  • Provide false or misleading information

  • Violate applicable intellectual property or other laws

Violation may result in suspension or legal action.

 

7. Intellectual Property

  1. All Site content — text, graphics, images, product descriptions and designs — is owned by or licensed to YourBike.cc.

  2. Content may only be used for personal, non‑commercial purposes.

  3. Reproduction, distribution, modification or republication is prohibited without written permission.

 

8. Disclaimers, Limitation of Liability & Warranty

  1. The Site and all content are provided “as is” and “as available.”

  2. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

  3. We are not liable for indirect or consequential damages, including loss of profits, data, or personal injury.

  4. Product performance, colour and compatibility descriptions are estimates only. No guarantee is given that they are error‑free.

  5. Consumers are entitled to the statutory 2‑year warranty on products purchased from us. This means that a product must function as the consumer may reasonably expect. If a product develops a defect within this period that is not caused by misuse, we will repair, replace, or reimburse the product in accordance with applicable legal requirements.

  6. For B2B customers, a warranty period of 1 year applies from the date of delivery, unless otherwise agreed in writing. This warranty covers manufacturing defects but excludes wear and tear, improper use, and damage caused by external factors.

 

9. External Links & Third‑Party Content

Our Site may contain links to third‑party websites. These are provided solely for your convenience. We do not control, endorse or guarantee the content, availability or accuracy of those websites. We are not responsible for any damages or losses resulting from your use of third‑party websites.

 

10. Amendments / Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting on the Site. It is your responsibility to check this page periodically for updates. Your continued use of the Site following changes constitutes your acceptance of the updated Terms.

 

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of The Netherlands. Any dispute, controversy or claim arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in The Netherlands, unless mandatory law provides otherwise.
